INTRODUCTION

Thank you for visiting Miyazato Diamonds (herein referred to as “The Site”). Your use of The Site is subject to the following Terms and Conditions. Your use of The Site implies that you agree to comply with these Terms and Conditions. Miyazato Diamonds may modify or make changes to these Terms and Conditions at its complete discretion. These Terms and Conditions may have changed from when you last made a purchase from Miyazato Diamonds. Therefore, please read and understand these Terms and Conditions carefully before making any purchase from Miyazato Diamonds.

ELIGIBILITY TO PURCHASE

The purchase of products is strictly limited to parties who can lawfully enter into and form contracts on The Site in accordance with English law. This includes the requirement to be at least 18 years of age.

When ordering items, you will be required to provide payment details and you must represent and warrant that the payment details you provide on ordering are both valid and correct and you confirm that you are the person referred to in the Billing information provided.  The site is available only to individuals and others who meet these Terms and Conditions, who have been issued a valid credit card by a bank, whose applications are acceptable to Miyazato Diamonds and who have authorised Miyazato Diamonds to process a charge to their credit card in the amount of the total purchase price for the goods which they purchase.

Purchases made on the site are for the personal or gift use of the buyer only and are not to be used for re-sale, commercial purposes or any other commercial benefit. Miyazato Diamonds reserves the right to restrict or question multiple quantities of an item being shipped to any one customer or postal address. Please note that by making an offer to purchase goods from the site, you expressly authorise Miyazato Diamonds to perform credit checks and, where Miyazato Diamonds feels necessary, to transmit or to obtain information (including any updated information) about you to or from third parties from time to time, including but not limited to your credit-card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.

ACCEPTANCE OF YOUR ORDER

We must receive payment in whole for the price of the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an e-mail to you at the e-mail address you provide.

Our acceptance of your order brings into existence a legally binding contract between us. This sale contract is concluded in London, England and the language of the contract is English.

We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold, removing, screening or editing any materials or content on the Site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

We will send confirmation of the order you have placed with us. A contract will come into place from the moment we accept your order. If we are unable to accept your order, we will inform you of this and will not charge you for the product. Reasons for this may be because:

Our product is out of stock. 
Of unexpected limits on our resources which we could not reasonably plan for.
We have identified an error in the price or description of the product. 
We are unable to meet a delivery deadline you have specified. 
Any other reason which we shall advise you of in writing

RING SIZING


Final decision on a ring size is the choice of the customer and once it’s been agreed and the deposit paid, the ring will be made to this given ring size. All finished pieces will be within a ¼ of a size (+ or -) of the specified ring size. Very slight variation will be inevitable in the manufacturing process. Miyazato Diamonds will adjust the ring size once as a complimentary service on engagement rings. Any further alterations will be charged.

No resizing can be offered on full eternity rings, any full set rings, and certain gemstone rings.

RETURNS

Your right to cancel your contract with us for all goods within a collection that you have ordered is subject to the following terms (this does not affect your Statutory Rights):

  • Not having worn or damaged the jewellery.

  • Goods are returned within 14 days of receiving your item.

  • The items must be packed securely in the packaging in which you received it. Miyazato Diamonds is not liable if items are returned to us broken and we ask that you ensure items are packaged safely and securely. You must at the same time return any accessories sent with the item (jewellery box, certificates and so on). Items returned without relevant certificates and boxes will be rejected by us and returned to you.

  • Once we have received the item(s) we will notify you by email and the appropriate action will be taken immediately.

Bespoke, commissioned pieces and engraved goods cannot be returned. Please see below for further information and our FAQs on bespoke items.

Once Miyazato Diamonds has confirmed your return, any sum debited from you credit card will be credited to your account as soon as possible and in any event within 30 days of your order provided that the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you, in the way detailed above, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be credited to you.

CANCELLED ORDERS

Client satisfaction is of importance to Miyazato Diamonds. After each purchase from The Site you have the right to a 7 day “cooling off period”. Subject to the conditions outlined above, you may cancel your contract with us for the goods you order at any time up to the end of the seventh working day from the date you receive the ordered goods.

We reserve the right to cancel the contract between you and us if:

  • We have insufficient stock to deliver the goods you have ordered;

  • We do not deliver to your area; or

  • One or more of the items you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from suppliers.

  • If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

PRICING AND PAYMENT

The prices payable for goods are set out on The Site. All prices are in GBP and inclusive of VAT. You will be billed in GBP and if you purchase from outside the UK, currency fluctuations and credit card charges may make a difference to the amount billed.

Payment can be made using Visa and Mastercard debit and credit cards.

You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to miyazatodiamonds.com, we will not be liable for any delay or non-delivery.

DELAYS

Miyazato Diamonds advises 4-6 weeks for all bespoke commissions, however, upon reviewing an order we can advise you that it will take longer. We will always tell you timeframes prior to confirmation.

Miyazato Diamonds will not be held responsible for delays in production timeframes for reasons that are outside of our control. We recommend allowing ample time for the production of bespoke jewellery pieces when placing orders in preparation for special events.

DELIVERY AND INSURANCE

We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. It is your responsibility to ensure that the delivery address you give us is correct and accurate and that there is somebody to sign for and take delivery of the goods from the delivery service used.

  • All orders within the UK are delivered using Royal Mail Special Delivery.

  • Delivery is made within the UK only.

You will become the owner of the goods you have ordered when they have been dispatched to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

If your order is returned to us because the courier or postal service could not complete the delivery to you for whatever reason, then you will be responsible for the repeat delivery costs.

We cannot be held responsible for any delays once the goods have left us and are in possession of the courier or Royal Mail.

DAMAGED OR DEFECTIVE GOODS

If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us by e-mail of the problem within 7 working days of the delivery of the goods in question on hello@miyazatodiamonds.com

COMISSIONED AND BESPOKE PIECES

You acknowledge that Bespoke Goods are customised goods that are made to order and therefore agree to the following:

  • that you shall comply with the payment conditions set out

  • that Bespoke Goods are 100% non-refundable; and

  • that the date on which your Bespoke Goods will be ready is an estimation and timings are approximate.

  • You hereby give permission to us to use photos and/or videos of the Bespoke Goods on the Website, social media profiles, presentations and any other marketing material for the purposes of promoting our business. You shall have the right to withdraw such consent at any time by giving written notice to us.

CONFIRMATION OF YOUR BESPOKE ORDER

Once all the details of the bespoke order have been confirmed, Miyazato Diamonds will send a confirmation email containing all relevant images, drawings, videos and quotations. You must then provide confirmation that you would like to go ahead with the bespoke order by email.
